Open Government Act Revisions FOIAXpress Compliance
The bill restores meaningful deadlines for agency action, by ensuring that the 20-day statutory clock under FOIA starts when a request is received by the appropriate component of the agency and requiring that agency FOIA offices get FOIA requests to the appropriate agency component within 10 days of the receipt of such requests. To address concerns that an agency might unreasonably delay in routing a request to the appropriate component, The bill clarifies that the deadline shall begin to run from no later than ten days after some designated FOIA component receives the request.

FOIAXpress has the flexibility to enable agencies to configure when the 20-day clock will begin.

FOIAXpress automatically tracks the days a request is being processed so that the FOIA component processing the request has real-time accountability of the days remaining to complete the request.

FOIAXpress employs a sophisticated inbox capability to control the assignment of cases and management of caseloads. The application can direct or redirect the case(s) to the appropriate agency component inbox. Using the “assign” function, the administrator can assign case(s) to one or multiple users or components. The cases can be re-assigned to one or multiple users, or one or multiple components. When assigning or re-assigning a case, the system routes the case to a user’s inbox, and generates (optional) email notifying the user of the assignment.

The bill allows federal agencies to toll the 20-day clock while they are awaiting a response to a reasonable request for information from a FOIA requester on one occasion, or while the agency is awaiting clarification regarding a FOIA fee assessment. FOIAXpress provides the flexibility to configure the system to stop the 20-day clock while waiting for a response back from the requester and resume the 20-day clock when the response is received from he requester.
Imposing real consequences on federal agencies for missing FOIA’s 20-day statutory deadline;

FOIAXpress is designed to provide alerts that remind the FOIA analyst about the pending tasks on a case before its due date expires. As FOIAXpress processes the requests, it checks the status of the requests and if there are any alerts on any requests with the target dates for requests and due dates for scheduled tasks respectively, i.e., pending tasks on pending cases are displayed. Users can check the “Pending Tasks under FOIAXpress Today” to see if there are any tasks which are pending on a case.

The system allows users to set specific due dates. Also, the system will automatically generate dates associated with processing a case(s) (e.g. received date, target date and date on the request letter). The user can easily modify the generated dates via a calendar function. Using the calendar, the user can set the day, month and year, for past, present or future processing actions. The system allows the system administrator to set the target date from three different times. The target date can be set to automatically calculate based on the screened date, received date, or assigned date.

In addition, a tickler box/folder allows the user to enter action items. When creating “required items” or items that require attention, the user can select dates, set up alerts, and set up distribution lists for the alerts. The system automatically sends alerts to those identified on the distribution list.

In addition, to encourage agencies to meet the 20-day time limit, the bill prohibits an agency from collecting search fees if it fails to meet the 20-day deadline, except in the case of exceptional circumstances as defined by the FOIA statute. Using FOIAXpress federal agencies will have the ability to manage and control the processing and tracking of all FOIA requests to ensure compliance with the 20-day time limit thereby ensuring that they will not lose revenue from search fees that could not be collected because they did not meet the 20-day deadline.
The bill clarifies that Buckhannon does not apply to FOIA cases. Under the bill, a FOIA requester can obtain attorneys’ fees when he or she files a lawsuit to obtain records from the government and the government releases those records before the court orders them to do so. But, this provision would not allow the requester to recover attorneys’ fees if the requester’s claim is wholly insubstantial. FOIAXpress cuts FOIA processing time, delays, and backlog; automates compliance and statistical reporting and manages workflow from initial scanning of a request letter to completion of case processing, tracking and workflow for initiating and tracking requests which will enable federal agencies to minimize the risk of having to pay a requesters attorneys fees.
Clarifying that FOIA applies to government records held by outside private contractors. FOIAXpress includes a document management module that facilitates and tracks the request for responsive documents to program offices and outside private contractors.
The bill does several things to enhance the agency reporting and tracking requirements under FOIA. Tracking numbers are not required for FOIA requests that are anticipated to take ten days or less to process. The bill creates a tracking system for FOIA requests to assist members of the public and the media. FOIAXpress comes with a case tracking system that will enable federal agencies to automatically assign case tracking numbers to every FOIA request it receives.
The bill clarifies that the definition of news media, for purposes of FOIA fee waivers, includes free newspapers and individuals performing a media function who do not necessarily have a prior history of publication. FOIAXpress provides the ability to configure multiple categories of requesters such as Commercial, Educational Institutions, Non-commercial Scientific Institutions, and news media.
The bill also establishes a FOIA hotline service for all federal agencies, either by telephone or on the Internet, to enable requestors to track the status of their FOIA requests.

Designed to meet the Executive Order requirements and openness in government, FOIAXpress/PAL allows the public to submit and track the status of Freedom of Information (FOIA) and Privacy Act (PA) requests over the Internet. Requesters submit their request electronically through a link on your agency Service Center or other website. Using PAL, the requester creates a user account that provides a login ID and password which allows the requester to submit, check status, and can also choose to have their response posted for download.

On August 3, 2007 the U.S. Senate passed the Open Government Act under bil S849. No Programming Required
